These Terms of Service ("Terms") govern your use of the StayHard website at https://stayhard.top ("Website") and the mobile application and services provided by StayHard. By using our Website, application, and services, you agree to these Terms.

1. Description of StayHard

StayHard is a habit tracking application that gamifies personal improvement through adaptive missions and tough-love coaching. Users build unstoppable habits through a +1% improvement system across different track types including running, cold showers, wake-up times, focus sessions, study, and strength training.

2. Service Plans and Billing

StayHard operates on a subscription-based model:
- StayHard Pro: $5.00 per month with a 7-day free trial
- Subscriptions automatically renew unless cancelled
- You may cancel your subscription at any time through your account settings
- Refunds are available within 7 days of initial purchase
- No refunds are provided for partial subscription periods after the initial 7-day period

3. User Accounts and Data

By creating an account, you agree to:
- Provide accurate and complete information
- Maintain the security of your login credentials  
- Be responsible for all activities under your account
- Not share your account with others
- Notify us immediately of any unauthorized use

4. Acceptable Use

You agree not to:
- Use the service for any illegal or unauthorized purpose
- Interfere with or disrupt the service or servers
- Attempt to gain unauthorized access to the service
- Upload malicious code or content
- Harass, abuse, or harm other users
- Create false or misleading content

5. Intellectual Property

The StayHard service, including all content, features, and functionality, is owned by StayHard and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the service for personal use only.

6. Data Collection and Privacy

We collect and process user data as described in our Privacy Policy at https://stayhard.top/privacy-policy. This includes habit tracking data, progress metrics, and personal information necessary to provide our services.

7. Service Availability

While we strive to maintain high availability, we do not guarantee that the service will be available 100% of the time. We reserve the right to modify, suspend, or discontinue the service at any time with reasonable notice.

8. Limitation of Liability

StayHard shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.
